1. Who you are contracting with
The Lumaye service (the "Service") is operated by Lumaye Hub("Lumaye", "we", "us", or "our"). Where these Terms refer to the "Customer", "you", or "your", they mean the individual or organization accessing the Service. By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms.
2. Acceptance
Your continued use of the Service constitutes acceptance of these Terms and of any updates we publish on this page. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
3. Product description and licence
Lumaye provides an AI operating system for industrial knowledge, including knowledge ingestion, copilots, specialist agents, maintenance workflows, vision inspection, and connected data integrations. Subject to these Terms and to payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
4. Acceptable use and misuse
You must not misuse the Service. In particular, you must not:
- use the Service for unlawful, fraudulent, or infringing activity;
- send spam or unsolicited communications through the Service;
- upload malware, probe or scan our infrastructure, or attempt to bypass access controls, rate limits, or security features;
- scrape, reverse engineer, resell, or redistribute the Service or its outputs except as expressly permitted;
- use the Service to generate content that is illegal, deceptive (including deepfakes designed to deceive), harassing, or that violates third-party rights.
5. Generative AI features
The Service uses generative AI models to produce answers, summaries, work orders, and other outputs. You are responsible for the prompts you submit, for verifying the accuracy of outputs before acting on them, and for ensuring you have the necessary rights to any inputs you provide. Outputs may be inaccurate or incomplete and are not a substitute for qualified engineering, safety, legal, medical, or financial advice.
We may filter, restrict, or refuse outputs and may remove content or suspend accounts that repeatedly generate prohibited material. If you believe content on the Service infringes your rights, contact support@lumaye.org and we will review the report and, where appropriate, take down the content and act against repeat infringers.
6. Your account and content
You must provide accurate registration information, keep it up to date, and maintain the confidentiality of your credentials. You are responsible for activity that occurs under your account. You retain ownership of the content and data you upload; you grant us a limited licence to host, process, and transmit that content solely to provide and improve the Service to you.
7. Intellectual property
The Service, its software, documentation, and branding are and remain the property of Lumaye Hub and its licensors. No rights are granted except as expressly set out in these Terms.
8. Payment, subscriptions, and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, currency conversion, tax collection, cancellation, and refund mechanics are governed by the Paddle Buyer Terms.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your customer portal at paddle.net.
9. Service level
We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free, or free from security vulnerabilities. To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends and we will make your data available for export for a reasonable window before deletion.
11. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited by law.
12. Indemnity
You will indemnify Lumaye Hub against third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
13. Changes to the Service or Terms
We may modify the Service and update these Terms from time to time. Where changes are material, we will provide reasonable notice. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which Lumaye Hub is established, without regard to conflict-of-law rules. The courts of that jurisdiction have exclusive jurisdiction over disputes arising out of or relating to these Terms, subject to any mandatory consumer-protection rules that apply in your country of residence.
15. Assignment and force majeure
You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond their reasonable control.
